Other Bill of Rights protections
Several less frequently tested provisions complete the Bill of Rights. The Third Amendment restricts quartering soldiers in private homes. The Fifth Amendment's Takings Clause generally requires just compensation when government takes private property for public use. The Seventh Amendment preserves jury trial in covered federal civil cases. The Ninth warns that listing some rights does not deny others retained by the people, and the Tenth reserves undelegated powers to the states or the people.
These provisions perform different work. The Takings Clause concerns compensation for a taking, not whether every regulation is wise. The Ninth Amendment is not a blank check for courts to announce any desired right. The Tenth confirms the federal system but does not defeat a valid exercise of national power made supreme by the Constitution.
Incorporation is provision-specific. Many protections apply to states through the Fourteenth Amendment, but a student should not assume that every clause has been incorporated in exactly the same way. The Seventh Amendment civil-jury guarantee, for example, has not been incorporated against the states, while the Takings Clause has.
For a CLEP item, match the fact pattern to the text before applying a broad label. Government occupation or acquisition of property raises takings questions; forced housing of troops raises the Third Amendment; a federal civil jury issue raises the Seventh. Distinguish the Tenth Amendment's reservation of powers from the Ninth Amendment's rule about unenumerated rights.
